THE SUPREME COURT OF THE REPUBLIC OF AZERBAIJAN

The Supreme Court of the Republic of Azerbaijan is a supreme juridical body on civil (as well as on the economical conflicts), criminal affairs, administrative faults and other affairs referring the execution of the general and specialized courts. As the instance cassation of the supreme court the Supreme Court implements jurisdiction in determined practical way and gives the explanations on court practice matters.

The judges of the Supreme Court of the Republic of Azerbaijan (23 judges) are appointed by Milli Mejlis on the presentation of the President of the Republic of Azerbaijan.

The Supreme Court is composed of the chair of the Supreme Court, his deputies and judges, Plenum and corresponding chamber.

The Plenum of the Supreme Court is composed of the Chair of the Supreme Court, his\her deputies, the chair of the Court of Economy, the chair of the Court of Appeal and the chair of the Supreme Court of the Autonomous Republic of Nakhchivan. The members of the Plenum of the Supreme Court possess equal rights within the frames of their authorities. The Plenum views the materials on the generalization of the court practice and analysis of the court statistics; in accordance with the preposition of the chair of the Supreme Court forms chamber of the Supreme Courts and distributes the judges on the chambers; sends the interrogation to the Supreme Court; views the interrogation of the President of Azerbaijan concerning dismissal of the Supreme Courts judges and within 30 days after interrogation presents corresponding reference to the President of the Republic of Azerbaijan; gives explanation on matters concerning the court experience; in accordance with the legislation views the affairs of extra cassation or new matters on violation of rights and freedoms by the presentation of the chair of the Supreme Court, the protests of the Chief Procurator of the Republic of Azerbaijan or the complaint of defending party; in cases determined by the legislation views the complaints about the decisions of the Board on Court and Legislation and implements other duties determined by the legislation.

The Supreme Court organizes the court chambers on civil affairs, affairs on economical disagreements, criminal affairs and the affairs on violation of the rights. The Supreme Court chambers view the following affairs: the affairs on cassation complaints on the matters viewed by the Court of Appeal and those on cassation protests; the affairs on cassation complaints on the matters viewed by the Court of the Economy and those on cassation protests; the affairs on cassation complaints on the matters viewed by the Supreme Court of the Nakhchivan Autonomous Republic as the instance appeal court and those on cassation protests; the affairs on cassation complaints on the matters viewed by other general and specialized courts in the way determined by the legislation and those on cassation protests and the affairs on the presentation given in cassation order by the chair of the Supreme Court in the ways and case determined by the law. The chambers of the Supreme Court analysis the court statistics, studies and generalizes the court experience, renders methodic assistance to the courts of the Republic of Azerbaijan and implements another duties determined by the legislation of the Republic of Azerbaijan.

The Supreme Court of the Republic of Azerbaijan is held in the capital-Baku, its jurisdiction is applied to the whole territory of the Republic of Azerbaijan.
